Being pregnant and outside the U.S.

If you are pregnant and already outside the U.S., speak with an attorney before attempting to re-enter, even if your trip was entirely legitimate and unrelated to your pregnancy. A valid visa stamp alone may not guarantee a safe and secure entry.

Carry strong & current documentation

You need to carry on your person as much authentic and current documentation as available. For H-1B workers, that usually means the approval notice, recent pay statements, and an employment verification letter. For F-1 students, it means a properly endorsed I-20, enrollment confirmation, and standard academic records. The goal is to make the legitimate purpose of your U.S. presence immediately clear to an officer.

Be truthful as much as possible

Answer every question as truthfully as possible. If asked directly about pregnancy, answer honestly. Misrepresentation to a CBP officer creates a separate and often more serious problem than the original question ever posed.

  • avoid unnecessary international travel while pregnant,
