UK to Inaugurate Faster Permanent Residency for High-Earners

Immigration pathways for high earners just became easier in the UK. People from a premium salary class will be allowed to settle down permanently in the UK within as little as three years. According to the Home Secretary, Shabana Mahmood, the government sought to minimise its immigration restrictions when it comes to retaining the skilled workers and the best talent in the UK.

Who is eligible for this visa?
Roughly speaking, visa holders earning more than £125,000 ($163,000) would be allowed to apply for this permanent residency visa after three years. We have got to know about this bit from the proposal Mahmood put out for public consultation on Thursday. This quickened track towards citizenship is likely going to have a strict vetting policy along with a tighter emphasis on language skills and criminal records. This visa will also have yet another layer of priority: those who earn a salary between £50,000 and £125,000 would have to wait five years, in line with the provision in effect. The wage-based nature of this policy is somewhat structurally identical to the wage-based H-1B visa program in the U.S.; however, the latter is not necessarily a route for permanent residency.
Mahmood voiced in this context: “To settle in this country forever is not a right, but a privilege. And, it must be earned.”
According to several reports, the new system will automatically apply to anyone who is in the country by lawful means and has not obtained an indefinite leave to remain. The Home Office’s calculations show that around 1.3 million to 2.2 million people could potentially become eligible for this status. In other words, they could work in the UK indefinitely by 2030.
A significant portion of these people are already part of the health and care visa route. This route was developed to accommodate qualified migrants to work in the UK’s understaffed social care sector. These employees are going to be subjected to a 15-year baseline rather than a 10-year period before they can claim the ILR, i.e., the shortest route to permanent residency in the U.K.
The four conditions you need to satisfy for ILR (Indefinite Leave to Remain)
If you are looking to qualify for the ILR, you need to satisfy the following four conditions:
- Have a clean criminal record
- Have cleared National Insurance contributions for the last three years
- Owe zero debt to the state, for example, to the Home Office or to the National Health Service
- Be able to speak English fluently as a foreign language to at least A-level standard.
If you can’t meet these criteria, you will not be allowed to apply for ILR. If a person arrives in the U.K. through an illegal route, such as on small boats, they may receive a penalty of 20 years over their 10-year baseline.
Moreover, if the administration recommends that certain cohorts of migrants (usually well-paid or serving a crucial social role) will see their baseline reduced. These usually include people who work in public services (Doctors, Nurses, Teachers).
