States Sue Trump Administration Over Plan to Share Welfare Data With ICE

A coalition of nearly two dozen Democratic-led states, joined separately by a group of civil rights organizations, filed suit this week to stop the Trump administration from handing federal immigration authorities access to the personal records of low-income families enrolled in one of the country's oldest safety-net programs. What does the lawsuit exactly argue?

The dispute centers on a policy the Administration for Children and Families (ACF), a division of the U.S. Department of Health and Human Services, announced in June. It would let ACF share records on families receiving Temporary Assistance for Needy Families (TANF) with other federal agencies, including the Department of Homeland Security. TANF is a federally funded, state-administered program that distributes more than $16 billion a year in cash aid and services to low-income households with children.

Twenty-three states and the District of Columbia sued in federal court in Washington against this practice. They argued that the law creating TANF put states, not Washington, in charge of verifying applicants' eligibility, and that ACF is now improperly asserting authority to oversee state programs and check recipients' immigration status.

California Attorney General Rob Bonta said the administration was exploiting a program built to keep children fed and help struggling families to fuel its mass surveillance effort. New York Attorney General Letitia James, whose office also joined the suit, said the administration is trying to turn anti-poverty programs against the people they are supposed to serve instead of addressing the rising cost of living.

A second, related lawsuit was filed in federal court in Brooklyn by the advocacy groups Make the Road States, Common Cause, and the Electronic Frontier Foundation. They collectively allege that the policy violates the Privacy Act and other federal data-protection laws. Common Cause's Jay Young argued the move could lead to children going hungry as families can potentially fear retaliation for seeking aid.

Both suits contend that the data-sharing plan violates the Administrative Procedure Act and the Constitution by disregarding existing restrictions on data use and imposing new & unauthorized conditions on federal funding. The policy is scheduled to take effect August 11. Several sources like Reuters have reported that shared records could include Social Security numbers, income, marital status and the immigration status. This is so not just of benefit recipients but of everyone in their households, the court filings reveal.

HHS has not responded publicly to the lawsuits, but the agency has defended the policy as necessary to confirm states are properly verifying TANF recipients' citizenship or immigration status before disbursing benefits.

Is it part of a broader pattern?

This is not the administration's first attempt to merge welfare data with immigration enforcement. Democratic attorneys general, again led by Bonta, sued HHS last year over a "mass transfer" of Medicaid data to Immigration and Customs Enforcement. Similar fights have played out over Supplemental Nutrition Assistance Program (SNAP) records and, separately, over the IRS sharing taxpayer addresses with ICE. In the current lawsuits, the States have argued that a consistent thread runs through all of these disputes: using benefits data collected under promises of confidentiality to locate and target immigrants. This onslaught even led to lawfully present immigrants fearing that applying for help could expose their families to enforcement.

The public charge connection

The TANF fight lands alongside a separate, far-reaching change to immigration policy that could compound the consequences. In July, the Department of Homeland Security finalized a new "public charge" rule, which revived and broadened a standard first imposed during Trump's first term. Rooted in a provision of the Immigration Act of 1882, the "public charge" ground of inadmissibility lets immigration officers deny green cards, visas, or entry to people they believe are likely to become primarily dependent on government support.

The new rule, taking effect September 18, undoes a 2022 Biden-era regulation that limited public-charge assessments largely to cash assistance and long-term institutional care. It instead restores broad officer discretion to weigh use of programs such as Medicaid, SNAP and housing assistance without specifying which benefits count. In this context, AILA President Jeff Joseph said the rule puts a dagger in the heart of legal immigration, particularly for families seeking to reunite through sponsorship.

Why the two issues are linked

Taken together, the TANF data-sharing policy and the revived public charge rule point in the same direction: making low-income immigrant families warier of government assistance despite their legal eligibility.

Even families with no undocumented members may now weigh whether applying for cash aid, food assistance, or Medicaid could somehow surface in an immigration file. And, this could happen either through direct data-sharing with DHS or through a future green card officer's discretion.

Advocacy groups argue this dual pressure undermines both the safety net and the integrity of the legal immigration system that public charge law is nominally meant to protect. And, these practices would deter people who are fully qualified from seeking assistance they and their children need.

The outcome of the lawsuits will greatly determine how the immigration landscape is further shaped.
