• Final action dates: When a green card or immigration visa can be approved.

The state of the employment-based categories in the current visa bulletin

EB-1: Priority workers

EB-1 remains current for almost all countries. It offers strong availability for those with extraordinary ability, outstanding research skills, or even multinational executives. For the Indian nationals, the final action date remains at February 15, 2022. Though it is not a big jump, it is a steady stride forward. Hence, EB-1 remains your best bet if you are not willing to resign to a long and excruciating wait list. We have seen in experience that the EB-1A waiting time is usually far less than the other categories.

EB-2: Advanced degree holders/exceptional ability

This category paints a bleak and discouraging picture in the current visa bulletin. This is truer for the Indian applicants. The final action date for India remains frozen at January 1, 2013. Hence, it can lead to a total of 12 years of waiting for many. If no unused visa spillovers happen, don’t expect significant movement for India.

EB-3: Skilled workers and professionals

This is quite a mixed bag, as projected in the latest visa bulletin. For India, the backlog has moved to April 22, 2013. Hence, it is progressing slightly ahead of EB-2 in India. In the ‘Other workers’ subcategory (Unskilled labour roles) for India, it remains at a different date: April 22, 2013. EB-3 India is slowly catching up to the EB-2 at last. However, you should not expect any rapid movement unless demand declines or a sudden spillover occurs.

EB-4: Special immigrants (Religious Workers, etc.)

The EB-4 category is completely unavailable across all countries for August 2025. This continues a months-long freeze due to demand far exceeding supply and an exhausted annual limit. EB-4 will likely remain unavailable until the start of the next fiscal year, in October 2025.

EB-5: Immigrant investors

For the unreserved EB-5 category, India climbs up to May 1, 2019. The set-aside EB-5 categories (Rural, High-Unemployment, Infrastructure) are current for almost all nations. It is a clear path for wealthy investors if they qualify under those substreams. EB-5 continues to reward those filing under reserved categories.

As you can see, among all the employment-based categories, the EB-1A waiting time is more or less caught up and steadily progressing. EB-1A is also achievable for most industry experts.
