This concern is all too common, as many entry-level applicants and employees are feeling helpless in the face of a predetermined slot system that automatically gives priority to a high-income senior-level employee group. However, saying so, there are still some strategic ways you can boost your H-1B lottery chances.

Strategies to optimize your wage level and increase your chances of the selections

Conduct a wage analysis
At this point, your sole strategy for dealing with an H-1B registration must be wage optimization. And, the first step would be to conduct a comprehensive wage analysis to compare the proposed salary against the standard wage tiers for the profession. And, in this stage, you may discover that the candidate’s proposed wage tiers fell even below the threshold for the next wage level.
To give you an instance, let’s say the candidate is offered a wage of $92,000 while the prevailing wage is $93,500, which amounts to no less than a $1,500 salary increase. Now, you may convince your company to negotiate this minor cost to the company, which, in turn, can give you a dramatic 100% to 200% rise in your lottery probability.
In other words, conducting a wage analysis should be your prelude to a solid H-1b lottery strategy, and at the end of which, you may see that you only need to negotiate the salary for a negligible amount in order to significantly boost your chances.
Selecting the right Standard Occupational Classification (SOC) code
During the H-1B filing, the employers need to select a Standard Occupational Classification (SOC) code. And, if possible, you should communicate with your employer to choose the SOC correctly. Often, there could be multiple SOCs for the same job role. And, in cases like these, choosing one SOC over the others could put you in a better position vis-à-vis the lottery. Let’s take the role of the ‘data analyst’. Now, this role might fit into several SOCs, such as 15-2098 (Data Scientists), 15-1121 (Computer Systems Analysts), or even 15-2031 (Operations Research Analysts). Interestingly, the standard wage for a Level III “Operations Research Analyst” might be much lower than the Level III “Data Scientist” in the same country. Hence, the trick here is to select a SOC that not only fits your job description, but also offers a more favourable wage distribution.
This strategy could be advantageous for both the employers and the employees, as the former could find that their existing salary offer already qualifies for the higher wage tier without necessarily increasing the payroll costs.
The strategy of geographic arbitrage
The wage level of a salary is intricately tied to the location of employment. For example, while a salary of $110,000 might be a level-1 wage (hence, fewer chances) in high-cost regions like the NYC or San Francisco, the same salary might qualify as level-III or level-IV wages in Austin or another remote location in the Midwest. This is a strategy H-1B employers can use if the job is performed in a remote or hybrid mode. They can put the job location in the low-cost regions so that the candidate’s chances can significantly skyrocket.
Though the new wage-weighted H-1B system may seem unfair and may make the entry-level candidates feel helpless, there are still some strategies to get around. And, these strategies are absolutely legal and must be performed jointly with the employer or with the employer’s consent.
