US Issues New Warning to Indian Students Amidst Immigration Crackdown

In a recent social media post, the US Embassy in India on Saturday issued a new warning to Indian students. The post states that there would be ‘serious consequences’ if they break any laws or get detained for any reason. These consequences could include being deported, having their visa revoked, or even being disqualified from obtaining any future visa opportunity. As an aspirant or applicant, you might be asking what this new warning could mean. As one of the leading EB-1A consultants, here, we have explored the entire story of the recent social media post that has surfaced.
What warning is there in the new post?
To put it in verbatim, the post states: “ US laws can have serious consequences for your student visa. If you are arrested or violate any laws, your visa may be revoked, you may be deported, and you may be eligible for future U.S. visas. Follow the rules and don’t jeopardize your travel. A U.S. visa is a privilege, not a right.” This post has been circulating on X.
The post in the wider context
This post was no isolated incident. A while ago, the embassy issued another warning. It has been stated that if you stay in the US for longer than permitted, you may face deportation and could be permanently barred from entering the country again.
However, this post has come into existence amid a changing landscape and with many new changes in the policy. Here are some of the things you need to know about this changing landscape.
New rules for Indian visa applicants
To begin with, the third-party passport collection has been recently prohibited at the US visa application centres from the first of August, with the exception of applicants who are under the age of 18.
In other words, this means that you will have to pick up your passport in person or pay for it to be delivered to your place. If the candidate is a minor, a parent or a guardian will have to pick up the passport on the child’s behalf. If a third party goes to pick up the letter, they will need a signed letter of authority from both parents. However, the duplicates of the letter sent by email or scan won’t be legally admissible.
The new transformation in the Interview Waiver program
From September 2, 2025, onwards, many candidates who were previously exempt from an in-person interview will now have to go to a US Embassy or Consulate to complete their interview. The age-based exemptions for in-person interviews have been eliminated recently. You can read about it here in full detail.
With all the rising changes, the US administration is more likely to tighten its noose of surveillance on the visa applicants and aspirants. You should take good care not to transgress any boundary or break any law in the U.S., whether knowingly or unknowingly.
