US Supreme Court Stands By H-1B Families and Protects H-4 Visa Holders

Last Tuesday, the U.S. Supreme Court rejected a case that intended to disempower the dependents of H-1B visa holders. The case challenged the rule that allows the dependents of H-1B visa holders to find employment in the United States. A group, namely Save Jobs USA, has filed the lawsuit, arguing that the federal immigration law does not permit these dependents to take jobs and steal vocations of employment from American workers.

However, the Supreme Court has dismissed the plea and refused to revisit the H-1B work rule for the dependents.

A detailed look at the case in question

Save Jobs USA is a prolific group participated by and comprised of American tech workers who claim they have been displaced by the influx of foreign workers. In this case, they have voiced their discontent against the dependents of the H-1B visa holders, who are also called the H-4 visa holders, in the following terms:

“With the H-4 Rule, DHS reversed its earlier interpretation and began allowing certain spouses of H-1B nonimmigrant workers to be employed, despite no such directive in the statute. Following the H-4 Rule, there was an explosion in the number of non-citizens authorized to work in the United States entirely through regulations.”

Though the Department of Homeland Security has further plans to propose rule changes and revisions regarding H-4 visa work authorisation, nothing tangible was put forward by the department. The D.C. Circuit Court upheld a lower court ruling and dismissed Save Jobs USA’s lawsuit.

Implications for the H-1B dependent/H-4 holders

The Supreme Court’s ruling should not be thought of as an isolated event bearing no universal implications. The Court’s decision brings huge relief for the H-1B dependents, otherwise known as the H-4 holders. The curt dismissal of the lawsuit implies that they can continue to work and live on American soil without the fear of a lawsuit snatching all their rights overnight. In other words, the court’s refusal to reopen the work policy for H-1B dependents dispelled a lot of uncertainty and anxiety.
