More Than Fifty Green Card Holders Face Deportations in Re-vetting of Older Cases
We know from official data that there are over 11 million immigration applications pending in the USCIS database. Yet, the Trump administration announced earlier that it is going to cast a fresh set of eyes on older green card cases and re-evaluate whether any undeserving people got into the system by illegitimate means. Hence, a full-scale reevaluation of permanent residency cases during the Biden administration is underway. And, in that wide net, around fifty such cases have turned up on the authority’s radar. Moreover, the Trump administration has inaugurated a dedicated unit for the purpose of screening all the past green card cases.
According to the sources of the New York Times and the Times of India, more than 2890 cases have been unearthed and reviewed till the first week of May. Interestingly, under the reassessment, more than 80% of the cases have come clean.
In what follows, our EB1A consultants have analyzed and focused on who should fear the risks of potential deportations in this case, and how to safeguard yourself from all possible risks of green card deportation.
The green card deportations are not random or indiscriminate
Interestingly, the currently reported fifty deportations are not indiscriminate and instead, reflect who may stand the chance to get deported. In this context, USCIS spokesperson Zach Kahler commented that people with a prior history of crimes ( like domestic violence, drug abuse, possession of illegal firearms, traffic crimes, etc.) are more likely to be reviewed by the new unit even if they are permanent residency green card holders. Moreover, there are applicants who lied to get a green card from the USCIS. Kahler also hinted at possible affiliations with terrorist groups as grounds for green card denial, as among the suspects and revoked residents, there are some who “admitted to membership in an organization suspected of illegally or illicitly obtaining export-controlled information and technology for Iran’s Islamic Revolutionary Guard Corps.”
Interestingly, aside from USCIS, there is now a new unit dedicated to reviewing and re-vetting green card cases. This new unit is called: ‘Tactical Operations Division’. Under the unit, there are also several subordinate wings, like LPR Operations, Denaturalization, and Refugee Reviewing. According to the report of The New York Times, there are now 40 immigration officers who are dedicated to working on the re-vetting.
Does deportation apply to the green card holders?
Yes, deportation may apply to the green card holders in several cases if they have a history of prior convictions or if it comes to light that they obtained their green cards through fraud. However, usually, the green card holders get a chance to defend themselves before an immigration judge.
