UK to Effect Visa Ban on Nations That Refuse to Take Back Their Deported Citizens

UK Home Secretary Shabana Mahmood has recently stepped in with a big announcement last Monday. She spoke of an effective visa ban on countries unless they accept the deported criminals and illegal immigrants, i.e. inhabitants of their own nations. Additionally, she has revealed a much deeper sweeping reform aimed at dealing with illegal immigration.

Which nations are likely to be affected by the UK visa ban?

The statement of the home minister has suggested that at the sword’s edge of this ban, the nations to suffer are most likely to be the non-cooperative ones. In other words, the nations which refuse to take back their own nationals who indulged in illegal immigration or criminal activities in the UK.

The first few countries to face such a ban are Angola, Namibia, and the Democratic Republic of Congo. Their nationals will not be awarded a UK visa anymore unless their governments rapidly cooperate on the removals and deportations.

To put it in the verbatim of the UK Home Office: “These countries face penalties for their unacceptably low co-operation and obstructive returns processes. Thousands of illegal migrants and criminals from these nations are currently in the UK.”

What is the spectrum of said ‘non-cooperation’?

The accusation of non-cooperation aimed at certain nations includes embassies failing to process removal paperwork in time, or even pushing the individuals to sign their own documents. All these practices can lead to blocking their own deportations into their respective nations.

According to the report of The Times (UK), India too runs a high risk of becoming one of the ‘blocked’ nations because the former is most resistant to taking back the illegal migrants.

Upcoming UK reforms to battle illegal immigration

According to several reports on the news outlets, the UK government is also about to overhaul certain reforms in order to put a stop to shady immigration. Notable among these steps is a reformation in Article 8. This article has been previously used in favour of the immigrants to forge dubious connections for the sole purpose of getting to stay in the UK. This Article is often used by the Court to clear immigrants from legal scrutiny.

Moreover, the UK also aims to work with partners at the Council of Europe to address the ‘over-expansive application’ of Article 3 (Protection against inhuman and degrading treatments). Many immigrants use this article to thwart their removals and deportations. This new overhaul or reform is being structured to restrict migrants into arguing their cases within a single appeal. If they lose there, they will have to face deportation.

Immigration news is not isolated facts, and a nation’s immigration policy is often tied to another’s. Hence, the UK’s visa ban and upcoming immigration reforms can send ripples through the international immigration landscape.
