From December 15 onwards, the US State Department has intensified its social media vetting procedure for skilled workers and employees. Both H-1B and H-4 professionals will be taken under the elaborate vetting procedure. Interestingly, while there is no official disclaimer, some candidates are now receiving a 221(g) slip. Many are perplexed regarding these slips and what they could potentially mean. A lot of applicants are immersing themselves in speculations about what these slips could legally imply. As always, our EB-1A green card consultancy has analysed this news in full detail, along with elucidating what this slip could stand for.
All you need to know about the 221(g) slip in the H-1B visa interview
It has come to our knowledge that many candidates, instead of getting a clear notification (approved/denied), are now getting a 221(g) slip. Moreover, they are also being asked whether their social media accounts are public or private. Some users and applicants are getting their visa approval status updated after the submission.
Some applicants and users on Reddit have come up with an explanation for this form. Some of them have experienced a change in their status by the end of the day. On the other hand, other applicants have revealed that they are still awaiting a response even after a few days. The popular theory suggests that the request would be approved soon if the visa officers are still retaining the passport. If the officers return the passport, people are speculating that the request could take a few months.
Here is what 221 (g) slip actually means: it is a notification under Section 221(g) of the US Immigration and Nationality Act. It essentially implies that the case is temporarily denied until an additional action is carried out. This could mean that either more paperwork is needed or further administrative processing of the matter is necessary. It may as well mean a need for some further clarification.
What does the 221(g) slip look like?
The slip can come in a wide number of colours. However, currently, all the candidates are receiving the same white slip. There is no point in erroneously attributing meaning to the colour the slip has come in. In the current context, 221(g) slip actually means that the decision is pending due to ongoing social media scrutiny. Immigration experts have concurred that the colour of the slip holds little significance; it is the instruction that matters the most.
Recently, many appointments for H-1B and H-4 visas have been rescheduled on short notice due to concerns regarding social media vetting. The 221(g) slip is such a notification of postponement or rescheduling of the interview until further notice. If you receive such a notice, there is no reason to panic. It simply means that your application is pending. You need to either substantiate your application with some documents and useful information, or you will just need to wait for a while. Either way, receiving the concerned form does not mean an outright cancellation in any manner or so.
