Quick snapshot: where each EB category stands

EB-1A Visa (Extraordinary Ability, Outstanding Professors/Researchers, Multinational Execs)

This category remains current for most countries. However, India holds at April 15, 2022, and China at January 1, 2023. This means most global applicants can proceed without delay. The Indian and Chinese applicants will also likely see substantial movement within the next few months. Unlike the other categories, EB-1 has been the most caught-up category.

EB-2 (Advanced Degree Professionals)

India stands at June 15, 2012, in this category. Hence, there are some significant backlogs trailing behind. Other countries remain mostly current. PERM labor certification delays continue to slow this category.

EB-3 (Skilled Workers/professionals)

India’s date is April 22, 2013, for this category, while other chargeability areas show progress to April 1, 2023.

EB-4 (Special Immigrants)

This category is unavailable across all countries due to visa cap exhaustion for FY 2025. A reopening isn’t expected until October 2025.

EB-5 (Investors)

Reserved categories (Rural, High-Unemployment, Infrastructure) remain current, while unreserved visas for China and India still show backlogs.

Why EB-1A might be your best bet

The EB-1A shows much less backlog than the other categories. Hence, this category can offer a faster and more flexible green card route. There is a widely held misconception that EB-1A remains reserved for extremely premium and blue-ribbon candidates. This is not so. If you have demonstrable experience of six years or more in a respective field (Art, Science, Humanities), you could fulfill the EB-1A requirements. All you will have to do is showcase your achievements in a way that the USCIS readily recognises.

Unlike EB-2 or EB-3, EB-1A does not require employer sponsorship or PERM labor certification. So, you can simply petition for yourself. Transitioning to EB-1 could dramatically shorten your wait and simplify your process to apply for a Green card.
